PROCLAMATION

RE: RESEARCH SANCTUARY

Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, hereby announces that effective from 11:00 A.M., Thursday, November 19, 2009 the following area is declared a RESEARCH SANCTUARY and is closed to shellfishing:

I. AREA DESCRIPTION:

ONSLOW COUNTY

Stump Sound, Northwest of ICWW Marker 41, Kings Creek in Spicers Bay

An area of approximately 1 acre bound by the following points and delineated by stakes and signs.

34° 28.8120’N – 77° 29.3660’W
34° 28.8020’N – 77° 29.3630’W
34° 28.7750‘N – 77° 29.4110’W
34° 28.7920’N – 77° 29.3000’W

II. GENERAL INFORMATION:

A. This proclamation is issued under the authority of G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52; and N.C. Marine Fisheries Rules 15A NCAC 03H .0103 and 03I .0109.

B. It is unlawful to violate provisions of any proclamation issued by the Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Rule 15A NCAC 03H .0103.

C. These areas will be used by the North Carolina Coastal Federation and the Aquarium=s Oyster Hatchery program to conduct research on oyster larvae/spat growth and survival.

D. N.C. Marine Fisheries Rule 15A NCAC 03I .0109, specifies that Research Sanctuaries may be in effect for one year, subject to renewal at the end of that year.
