M-25-2009 PROCLAMATION RE: - GILL NETS - CAPE FEAR RIVER Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, hereby announces that effective at 7:30 A.M., Wednesday, November 11, 2009, the following will apply to the gill net fishery in the lower Cape Fear River: I. GILL NET RESTRICTIONS: The gill net attendance requirement in the lower Cape Fear River is no longer in effect. II. GENERAL INFORMATION: A. This proclamation is issued under the authority of N.C.G.S. 113.170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Rules 15A NCAC 03H .0103, and 03J .0103. B. It is unlawful to violate provisions of any proclamation issued by the Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Rule 15A NCAC 03H .0103. C. The intent of this proclamation is to end the attendance requirement for the gill net fishery in the lower Cape Fear River intended to reduce interactions with threatened and endangered sea turtles. Observations indicate turtles have decreased in abundance in this area. D. This proclamation supersedes M-21-2009, dated September 21, 2009.
