PROCLAMATION

RE: GILL NETS-WESTERN PAMLICO SOUND AND RIVERS

Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, hereby announces that effective 12:01 A.M., Thursday, January 1, 2009, the following will apply to gill nets in western Pamlico Sound and subject rivers:

I. PROCLAMATION RESCINDED

Proclamation M-9-2008 dated April 28, 2008 IS RESCINDED.

II. GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G. S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Fisheries Rules 15A NCAC 3H .0103, 3J .0103.

B. It is unlawful to violate the provisions of any proclamation issued by the Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Rule 15A NCAC 3H .0103.

C. The gill net tie-down and attendance requirements imposed by Proclamation M-9-2008 are being lifted for a period during shad season. These restrictions are established in the North Carolina Estuarine Striped Bass Fishery Management Plan to reduce large mesh gill net bycatch and will be implemented again by a later proclamation.

D. This proclamation supersedes Proclamation M-9-2008, dated April 28, 2008.
