PROCLAMATION

RE: RESEARCH SANCTUARY

Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, hereby announces that effective at NOON, Thursday, September 6, 2007, the following area is declared a RESEARCH SANCTUARY and IS CLOSED to all fishing equipment:

AREA DESCRIPTION:

DARE COUNTY
Jockeys Ridge Roanoke Sound Estuarine Access
An area on the sound side of Jockeys Ridge Roanoke Sound Estuarine Access on Soundside Road in Nags Head as shown on the attached map. The site is delineated as an area marked by posts and research sanctuary signs. The posts and signs are located at the following coordinates.
1. 35° 57.090’ N - 75° 37.968’ W
2. 35° 57.090’ N - 75° 37.970’ W
3. 35° 57.087’ N - 75° 37.968’ W
35° 57.088’ N - 75° 37.966’ W

II. GENERAL INFORMATION

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52; and N.C. Marine Fisheries Rules 15A NCAC 3H .0103 and 3I .0109.

B. It is unlawful to violate provisions of any proclamation issued by the Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Rule 15A NCAC 3H .0103.

C. Stakes and signs posted by the applicant will mark the area closed to fish and shellfish harvest.

D. N.C. Marine Fisheries Rule 15A NCAC 3I .0109, specifies that this Research Sanctuary is in effect for one year, subject to renewal at the end of that year.

E. This action is being taken to allow research to be conducted on oyster growth studies by Jockeys Ridge State Park, The Nature Conservancy and the N.C. Division of Marine Fisheries.
