SF-8-2006 PROCLAMATION RE: SHELLFISH MANAGEMENT AREA Preston P. Pate, Jr., Director, Division of Marine Fisheries, hereby announces that effective at 8:00 A.M., Sunday, October 15, 2006, the following areas are declared SHELLFISH MANAGEMENT AREAS and ARE CLOSED to the taking of oysters and clams (see section V. D and E) DARE COUNTY A. CROATAN SOUND - An area located 1.0 nautical miles west of Channel Marker #1 at the southern end of Roanoke Island as shown on Map 1. The area is delineated by Artificial Reef Buoys. The locations of the buoys are as follows: 1. NE Corner 35° 48.2842’ N 75° 38.3360’ W B. CRAB HOLE - An area as shown on Map 1. The area is delineated by Oyster Sanctuary Buoys. The locations of the buoys are as follows: 1. NE Corner 35° 43.6833’ N 75° 40.5083’ W 1. NW Corner 35° 17.4784’ N 75° 37.4173’ W DEEP BAY - An area located 0.5 nautical miles northwest of Channel Marker #2 as shown on Map 1. 1. NW Corner 35° 22.9126’ N 76° 22.3377’ W
OCRACOKE – An area located 1.4 nautical miles northeast of Channel Marker 14 BF as shown on 1. NE Corner 35° 10.8150’ N 75° 59.6320’ W WEST BLUFF – An area located 3.0 nautical miles east of the Channel Marker 1 at the entrance to Juniper Bay as shown on Map 1 & 2. The area is delineated by Oyster Sanctuary Buoys. The locations of the buoys are as follows: 1. NE Corner 35° 18.3000’ N 76° 10.0890’ W III. CARTERET COUNTY A. WEST BAY - An area located 1.3 nautical miles east of Tump Island as shown on Map 1 & 2. The area is 1. NE Corner 34° 58.8517’ N 76° 21.3632’ W NEUSE RIVER – An area located 1.5 nautical miles west of Channel Marker 1A at the entrance of 1. NE Corner 35° 00.4742’ N 76° 31.9550’ W IV. PAMLICO COUNTY A. MIDDLE BAY – An area located 1.0 nautical miles west of Restricted Area Marker B at the entrance of Middle Bay as shown on Map 1 & 2. This area is delineated by one buoy located near the center of the area with following corner coordinates: 1. NE Corner 35° 14.1580’ N 76° 30.1780’ W V. GENERAL INFORMATION: A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52; and N.C. Marine Fisheries Rules 15A NCAC 3H .0103 and 3K .0103. B. It is unlawful to violate provisions of any proclamation issued by the Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Rule 15A NCAC 3H .0103. C. The shellfish management areas have been designated because they contain shellfish enhancement projects that will enhance oyster growth and reproduction under protected conditions which will benefit oyster production in these areas. It is unlawful to use a trawl net, long haul seine, or swipe net or take oysters or clams in any designated Shellfish or Seed Management Area per 15A NCAC 03K .0103. E. It is unlawful to use any dredge or other mechanical method to take oysters on any posted bottom upon F. The Division of Marine Fisheries will mark the affected areas with buoys indicating ‘ARTIFICIAL REEF” or “Oyster Sanctuary” buoys insofar as may be practicable. No unauthorized removal or relocation of any such buoy shall have the effect of changing, nor shall any such buoy affect the applicability of any proclamation or portion thereof. Where there is conflict between buoys and maps, maps shall prevail.
