PROCLAMATION

RE: SHELLFISH MANAGEMENT AREA

Preston P. Pate, Jr., Director, Division of Marine Fisheries, hereby announces that the following Shellfish Management Areas shall open to the taking of clams by hand or hand tongs effective at sunrise, Monday, October 24, 2005:

I.    AREA DESCRIPTION

 NSLOW COUNTY

      ALL SHELLFISH MANAGEMENT AREAS IN NEW RIVER, ALLIGATOR BAY, AND HOWARDS BAY

      WITH THE FOLLOWING EXCEPTIONS:

Alligator Bay (CF) and Everett’s Bay Oyster Management Areas- The North Carolina Coastal Federation’s cultch/monitoring sites located on the southeast side of Alligator Bay and the northeast side of Everett’s Bay shall remained closed to the taking of clams and oysters.  These areas are shown as the hatched area on the attached Map 1.

II.   GENERAL INFORMATION

 

      A.   This proclamation is issued under the authority of G.S. 113-170.4; 113-170.5; 113-183; 113-182; 113-221.1; 143B-289.52 and implementing Marine Fisheries Rules 15A NCAC 3H .0103 and 3K .0103.

  1. It is unlawful to violate the provisions of any proclamation issued by the Fisheries Director under his delegated authority per Marine Fisheries 15A NCAC 3H .0103.

 

  1. The Fisheries Director, may by proclamation, designate Shellfish Management Areas in accordance with  Marine Fisheries Rule 15A NCAC 3K .0103 effective March 1, 1994.  The Fisheries Director may close Shellfish Management Areas to the taking of oysters or clams in accordance with Marine Fisheries Rule 15A NCAC 3K .0103(c).
  1. The experimental sites located within West Stones Bay and Courthouse Bay Management Areas shall OPEN to the taking of clams and oysters. 

 

  1. These areas will close to the taking of clams upon the closing of oyster season in 2006.
