RE: GILL NETS AND SEINES– SPOONERS CREEK

P. Pate, Jr., Director, Division of Marine Fisheries, hereby announces that
effective at 5:00 P.M., Sunday, November
10, 2002, the following provisions shall apply to the use of gill nets and seines in the area described
below:
I.
AREA
DESCRIPTION:
Spooners
Creek Entrance Channel in Bogue Sound, all of Spooners Creek proper and the
adjoining tributary canals and channels.
II. NET RESTRICTIONS:
No recreational or commercial gill
nets or seines may be used in Spooners Creek or the
entrance channel leading to Spooners Creek from
sunset to sunrise year round.
III.
GENERAL
INFORMATION:
(A)
This proclamation is issued under the
authority of G.S. 113-182; 113-170.4; 113-170.5; 113-221(e); 143B-289.52 and
N.C. Marine Fisheries Rule 15A NCAC 3H .0103 and 3J .0103.
(B) It
is unlawful to violate provisions of any proclamation issued by the Fisheries
Director under his delegated authority per 15A NCAC 3H .0103 (b).
(C) The
intent of this proclamation is to eliminate conflict between gill net fishermen
and residents of Spooners Creek development which occurs at night during the
prosecution of directed fisheries for mullet and other species.
(D) This proclamation does not supersede or
suspend the prohibition of gill nets and seines in Marine Fisheries Rule 15A
NCAC 3J .0402 (b) (4) (C) in the entrance channel and marina from May 1 through
November 30. It restricts the use of nets at night in the entire creek year
round.
