PROCLAMATION

RE: MECHANICAL HARVEST OF CLAMS

Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, hereby announces that effective at 7:00 A.M., Monday, June 7, 2010, the following area will temporarily open to the harvest of clams by mechanical means:

I. AREA: CARTERET COUNTY

Davis Bay - All those waters in Davis Bay and Turner Creek north of a line beginning at a point on the west shore at 34°43.0360’ N -76°37.4466’ W; thence in an easterly direction across the channel to a point on marsh at 34°43.2134’ N -76°36.8888’ W with the exception of all those waters in Howland Rock Canal and within 200 feet of the dockage in the canal which will remain closed (see map).

II. HARVEST LIMITS:

Harvest will be allowed from 7:00 A.M. to 4:00 P.M. Mondays through Fridays. A maximum daily harvest limit of 8,750 clams (35 bags at 250 clams per bag) in possession will be allowed per fishing operation. The minimum size limit will apply. No mechanical harvesting shall take place within 25 feet of private piers or seawalls.

III. GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-182; 113-221 (e); 143B-289.52 and N.C. Marine Fisheries Rules 15A NCAC 03H .0103 and 03K .0301 and .0302.

B. It is unlawful to violate the provisions of any proclamations issued by the Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Rule15A NCAC 03H .0103.

C. This is a temporary opening based on current biological conditions and will close when the area is closed again for the protection of public health.
