PROCLAMATION

RE: RESEARCH SANCTUARY

Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, hereby announces that effective at 7:00 A.M., Thursday, April 1, 2010, the following areas are declared RESEARCH SANCTUARIES and ARE CLOSED to the taking of shellfish and use of all fishing equipment:

AREA DESCRIPTION:

DARE COUNTY

Waves, NC - An area in Pamlico Sound off Waves, N.C. within 50 feet of a stake located at the following coordinates: 35° 33.8640’ N - 75° 28.3090’ W. The stake is marked by a research sanctuary sign.

Avon, N.C. – An area inside the T-dock in Mariner’s Cove Marina delineated by signs and located at the following coordinates: 35º 21.6920’N - 75º 30.172’W.

II. GENERAL INFORMATION

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52; and N.C. Marine Fisheries Rules 15A NCAC 03H .0103 and 03I .0109.

B. It is unlawful to violate provisions of any proclamation issued by the Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Rule 15A NCAC 03H .0103.

C. Stakes and signs posted by the applicant will mark the area closed to fish and shellfish harvest.

D. N.C. Marine Fisheries Rule 15A NCAC 03I .0109, specifies that this Research Sanctuary is in effect for one year, subject to renewal at the end of that year.

E. This action is being taken to allow research to be conducted on oyster cultch materials by N.C. Sea Grant.
