PROCLAMATION
RE: 2001
CALICO SCALLOP SEASON
Preston P. Pate, Jr., Director, Division of Marine
Fisheries, hereby announces that effective at 9:00 A.M., Saturday, February 17,
2001, the calico scallop season WILL OPEN
with the following restrictions:
GENERAL INFORMATION
A. This proclamation is issued under the
authority of G.S. 113-182; 113-221 (e); 143B-289.52 and N.C. Marine Fisheries
Rules 15A NCAC 3H .0103, 3J .0202 (4) & (5)(a), 3K .0504, 3L .0202 and 3M
.0503(j)(3).
B. It is unlawful to violate the
provisions of any proclamation issued by the Fisheries Director under his
delegated authority per 15A NCAC 3H .0103.
C.
Fishermen are reminded of Rule 15A NCAC 3J .0202(5)(a) which
states that it is unlawful to possess finfish (including pursuant to 15A NCAC
3M .0102) incidental to shrimp or crab trawl operations from December 1 through
March 31 unless the weight of the combined catch of shrimp and crabs exceeds
the weight of finfish except as provided in Sub-Item (5)(b) of this Rule. For purposes of enforcing this rule, calico
scallop trawls will be considered a shrimp or crab trawl.
D. Fishermen are reminded that a Shellfish License or Shellfish
Endorsement is required to take shellfish in North Carolina state waters, which
are defined for purposes of calico scallops as the Atlantic Ocean inside 3
miles.
E. During any closed season prior to November 1, vessels may
land up to 100 pounds of flounder per trip taken from the Atlantic Ocean.
F. TO
HARVEST CALICO SCALLOPS CONSISTENT WITH EXISTING STATE AND FEDERAL REGULATIONS,
ONLY TRAWLS MAY BE USED AS DEFINED IN RULE 15A NCAC 3J. 0202(4).
