PROCLAMATION
RE: GILL NETS
Preston P.
Pate, Jr., Director, Division of Marine Fisheries, hereby announces that
effective at 12:01 A.M., Tuesday,
January 1, 2002 until midnight, Tuesday, April 30, 2002, the following
restrictions will apply to gill nets:
I. AREA RESTRICTIONS: ATLANTIC OCEAN:
New Hanover
County, from Carolina Beach Inlet to
the Southern boundary of Fort Fisher State Park (near the former location of
New Inlet) from the beach seaward to three (3) nautical miles.
II. FISHERY RESTRICTIONS:
Gill nets with
a mesh length greater than 5 inches may not be used.
III. GENERAL INFORMATION:
A. This
proclamation is issued under the authority of G.S. 113-170.4; 113-170.5;
113-182; 113-221(e); 143B-289.52 and N.C. Marine Fisheries Rules 15A NCAC 3H
.0103 and 3J .0103.
B. It is
unlawful to violate the provisions of any proclamation issued by the Fisheries
Director under his delegated authority per 15A NCAC 3H .0103.
C. The intent of
this proclamation is to restrict the harvest of migrating American shad by
intercept fisheries in the described area as recommended by the Atlantic States
Marine Fisheries Commission Fishery Management Plan for American Shad.
D. This
proclamation will expire at midnight on April
30, 2002, unless superseded by
another proclamation.
