PROCLAMATION

RE: SHELLFISH POLLUTED AREA

Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Jeffrey P. Engel, M.D., State Health Director, Department of Health and Human Services, hereby announces that the following changes in shellfish harvesting areas will take effect at sunrise, Friday, September 11, 2009.

All those waters in Carteret County will return to the status in existence immediately prior to the September 7 and 8, 2009 temporary closures with the following exceptions which will remain closed:

New Hanover / Pender / Onslow / Carteret Counties

All those waters bordered on the northeast by a line from the western tip of Bogue Banks through ICWW Beacon #45 to the mainland and bordered on the southwest by the Figure Eight Island Bridge, to include White Oak River, Queens Creek, Bear Creek, Freeman Creek, New River, Chadwick Bay, Stump Sound and all other tributaries, bays, and sounds (see map).

All those waters from the Intracoastal Waterway to the mainland between the Morehead City permanent closure line near 16th Street and ICWW Beacon #45, near Cedar Point (see map).

Newport River - All those waters in Newport River upstream of the Highway 70 High Rise Bridge and Morehead-Beaufort Causeway, to include all tributaries and Core Creek.

All those waters bordered on the northeast by a line beginning at Hall Point near Thorofare Bay; running southeasterly through Fl. Beacon # 20 in Core Sound to a point on the Core Banks shoreline and bordered on the southwest by a line beginning at the eastern tip of Carrot Island; running easterly to the Beaufort permanent closure line near Channel Marker #56B; running easterly to the western tip of Harkers Island; thence in a straight line thru the two Flashing Beacons in Turtle Reef Channel to a point on Shackleford Banks. This includes North River, The Straits, a portion of Back Sound, Jarrett Bay, Oyster Creek, Nelson Bay and Core Sound (see map).

Cedar Island Bay / Rumley Bay / Thorofare Bay – All those waters in Cedar Island Bay, Rumley Bay, and Thorofare Bay upstream of a straight line beginning at Hog Island Point thence across the bay to Long Point, to include Lewis Creek; thence in a straight line to Lookout Point; thence in a straight line to Hall Point (see map).

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Rules 15A NCAC 3H .0103 and 3K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Rule 15A NCAC 3H .0103.

C. This proclamation returns the following areas to normal closure boundaries: a portion of Bogue Sound, including Tar Landing Bay, and the Beaufort Inlet area, including Middle Marshes.

D. These reopenings are due to satisfactory bacteriological sampling results.
