PA-1-2010 PROCLAMATION RE: SHELLFISH POLLUTED AREA Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Jeffrey P. Engel, M.D., State Health Director, Department of Health and Human Services, hereby announces that the following changes in shellfish harvesting areas will take effect at sunrise, Monday, January 4, 2010. All those waters in Onslow and Carteret Counties will return to the status in existence immediately prior to the November 11, 2009 and December 3 and December 19, 2009 temporary closures with the following exceptions, which will remain closed: BRUNSWICK / NEW HANOVER / PENDER / ONSLOW / CARTERET COUNTIES Shallotte River - All those waters in Shallotte River upstream of a straight line beginning at Shell Point on the north shore of Shallotte Creek; thence across the river to the west shore at a point 300 yards south of The Swash. All those waters between ICWW marker “71” near western Holden Beach and Fl. Beacon #48A near eastern Holden Beach. All those waters from the Intracoastal Waterway to the mainland between the Surf City Bridge and the Figure Eight Island Bridge. All those waters bordered on the northeast by a straight line from Swan Point through ICWW Channel Marker #4 to the eastern tip of West Onslow Beach, (south shore of New River Inlet), and bordered on the southwest by the Surf City Bridge. New River - All those waters upstream of a line beginning on the north shore of New River at Grey Point, running southeasterly to a point on the south shore of New River north of Goose Creek. Queens Creek – All those waters in Queens Creek upstream of a straight line across the mouth. White Oak River - All those waters in White Oak River upstream of the Highway 24 Bridge at Swansboro. Hunting Island Creek - All those waters in Hunting Island Creek upstream of a straight line across the mouth. Newport River - All those waters in Newport River upstream of the Highway 70 High Rise Bridge and Morehead-Beaufort Causeway, to include all tributaries and Core Creek. Long Bay – All those waters in Long Bay upstream of a straight line from the north shore of Fur Creek running easterly to Swimming Point. A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Rules 15A NCAC 03H .0103 and 03K .0101. B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Rule 15A NCAC 03H .0103. C. This proclamation returns the following areas to normal closure boundaries: The Intracoastal Waterway area between ICWW Marker #65A, near Sallier’s Bay, and Fl. Beacon #25 in Bogue Sound, not including Queens Creek, White Oak River or Hunting Island Creek. D. These reopenings are due to satisfactory bacteriological sampling results.
